Subject: Prescription for validity of certificate, dispensation certificate and
criteria methods and conditions for renewal of certificates

For the prescription for validity of certificate, dispensation certificate and Criteria methods and conditions for renewal of certificates issued in accordance with the with Marine Department’s Regulation on the certification of seafarers operating in ships engaged on near-coastal voyages and ships engaged on international voyages B.E. 2565 (2022), to be compliance with the prescription of the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers 1978 (STCW), as amended and Seafarers’ Training, Certification and Watchkeeping (STCW) Code annexed to the STCW Convention and its annexes.

By virtue of Section 279 of the Navigation in Thai Waters Act B.E. 2456 (1913) as amended by of the Navigation in Thai Waters Act (No. 13), B.E. 2525 (1982) including Clause 5, 13, 42, 46, 48, 52 and 53 of the Marine Department’s Regulation on the certification of seafarers operating in ships engaged on near-coastal voyages and ships engaged on international voyages B.E. 2565 (2022), the Director General of the Marine Department has announced the prescription for validity of certificate, dispensation certificate and
criteria methods and conditions for renewal of certificates as follows;

Clause 1 This announcement shall come into force after its publication in the Government Gazette onwards

Clause 2 Repeal the Marine Department’s Announcement No. 191/ B.E. 2563 (2020) on prescription for criteria, methods and conditions for renewal of certificates issued in accordance with Clause 6 of Regulations of the Marine Department on Training, Examination and Certification for Seafarers B.E. 2557 (2014) issued on 22 September B.E. 2563 (2020)

Clause 3 In this announcement

‘Regulations’ means Regulations of the Marine Department On the certification of seafarers operating in ships engaged on near-coastal voyages and ships engaged on international voyages B.E. 2565 (2022)

‘Certificate’ means Certificate of Competency (CoC), Certificate of Proficiency

(CoP), Certificate of Endorsement (CoE) issued in accordance with Regulations of the Marine Department On the certification of seafarers operating in ships engaged on near-coastal voyages and ships engaged on international voyages B.E. 2565 (2022)

Clause 4 Prescription for validity of certificate and dispensation certificate

4.1 The following certificates shall have validity of 5 years since the date of issuance

(1) Certificate of Competency (CoC) and Certificate of Proficiency (CoP) issued in accordance with Chapter 2 and Chapter 3 of the regulations

(2) Certificate of Endorsement (CoE) Certificate of Proficiency (CoP) issued in accordance with Chapter 5 of the regulations

(3) Certificate of Proficiency (CoP) issued in accordance with Chapter 6 the regulations

4.2 The following certificates shall have validity not exceeding the validity of the Certificate of Competency (CoC), Generator Operator’s License (GOC) or Restricted Operator’s License (ROC), depending on each case

(1) Certification of additional rights issued in accordance with Clause 39 of the regulations

(2) Certificate of accreditation of GMDSS radio operation or issued in accordance with Chapter 4 of the regulations

4.3 Certificate of Recognition (CoR) issued in accordance with Chapter 48 of the regulations shall have the validity not exceeding the validity of the certificates issued by other state parties, but shall not exceed the validity of 1 year since the date of issuance.

Clause 5 The renewal of the certificates shall proceed as follows;

5.1 Applicants for the renewal of Certificate of Competency (CoC) and Certificate of Proficiency (CoP) issued in accordance with Chapter 2 and 3 of the regulations must have the following qualifications

(1) Have health readiness and have received medical certificate issued in accordance with Chapter 1 Part 8 of the regulations and the medical certificate must not have expired

(2) Have sea going service in accordance with capacity and position prescribed in the holding certification for at least 12 months within the prior 5 years or at least 3 months within 6 months before the expiry

In case where the applicants do not have the complete period of seagoing service in accordance with the qualifications prescribed in (2), the applicants must one of the following qualifications to substitute the mentioned period of seagoing service

  1. For the Certificate of Proficiency (CoP) of the ratings of the Engine Department, Certificate of Competency (CoC) of Electro-technical officer, the applicants must have passed the electronic theoretical examination for the evaluation of competency for the intended level of certificate renewal. For the other certificate renewal, the applicants must not have to pass the electronic theoretical examination for the evaluation of competency, but must have passed the interview examination for the evaluation of competency for the intended level of certificate renewal or

  2. Must have completed the training course for renewal of certificate

in the level they intend to renew from the training institutes approved by the Marine Department.

5.2 The applicants for Certificate of Endorsement (CoE) Certificate of Proficiency (CoP) issued in accordance with Chapter 5 the regulations must have the following qualifications;

(1) Have health readiness and have received medical certificate issued in accordance with Chapter 1 Part 8 of the regulations and the medical certificate must not have expired

(2) Have seagoing service or training as follows;

(2.1) Have seagoing service as appropriate for the certification for operating on specific ship type for at least 3 months within the 5 years or

(2.2) Have completed the training course as prescribed by the director general.

5.3 The applicants for Certificate of Proficiency (CoP) issued in accordance with Chapter 6 the regulations must have the following qualifications;

(1) Have health readiness and have received medical certificate issued in accordance with Chapter 1 Part 8 of the regulations and the medical certificate must not have expired

(2) In case of application for renewal of Certificate of Proficiency (CoP) for basic training, Certificate of Proficiency (CoP) for survival craft and rescue boats other than fast rescue boats, Certificate of Proficiency (CoP) for fast rescue boats or Certificate of Proficiency (CoP) for advance fire training, the applicants must provide the following documents;

(2.1) Evidence of seagoing service in the responsible position onboard which is appropriate to the Certificate of Proficiency (CoP) intended for renewal, must have the seagoing service of at least 12 months within the prior 5 years or at least 3 months within 6 months before the expiry. Documentation evidence of onboard drill related to the Certificate of Proficiency (CoP) intended to renew such as evidence of onboard training for launching survival craft and rescue boats other than fast rescue boats, onboard fire fighting including other documents such as muster list must be provided in order to indicate that the applicants have been assigned to the responsible position which is appropriate to the certificate or

(2.2) Evidence of refresher course completion approved by the Marine Department related to the Certificate of Proficiency (CoP) intended for renewal, the period of the course completion prior to the application date must not exceed 5 years

5.4 If the applicants for certificate renewal issued in accordance with Regulations of the Marine Department on Training, Examination and Certification for Seafarers B.E. 2557 (2014) as amended wish to apply for certification of the regulations must pass the training course for knowledge adjustment.

Clause 6 The counting of period of seagoing services renewal of certificate in accordance with Clause 5 is as follows;

6.1 The applicants for the renewal of certificates for operation in near coastal voyage vessel or ships engaged in international voyage, the counting of period of seagoing services are as follows;

(1) In case where the operation complies with the capacity prescribed within the certificate or operation that any certificate prescribes the right of operation, the counting of period of seagoing services shall be counted by the actual period of seagoing service

(2) In case where the operation does not comply with the capacity prescribed within the certificate

(2.1) In case that the certificate holder is in the management level or operational level who operate in the position of the ship officer or above, the counting of period of seagoing services shall be counted by the actual period of seagoing service

(2.2) In case that the certificate holder is in the management level or operational level who operate in the position lower than the ship officer, the counting of period of seagoing services shall be counted by the half of actual period of seagoing service, part of day shall be counted as a day.

(2.3) In case that the certificate holder is in the support level, operated in the position which requires the same level certificate, the counting of period of seagoing services shall be counted by the actual period of seagoing service

6.2 The applicants for certificate renewal who operate in ships which are not near coastal voyage vessels or ships engaged in international voyage, the counting of period of seagoing services shall be counted by the half of actual period of seagoing service, part of day shall be counted as a day.

6.3 The applicants for certificate renewal who do not operate on ships, , the counting of period of seagoing services shall be counted by the half of actual period of seagoing service, part of day shall be counted as a day.

The applicants for certificate renewal in accordance with paragraph 1 must provide authentic In-Service Record Book and produce the explanation on relation and

 correlation of tasks which prescribed in the certificate intended for renewal, explaining the relations, for the committee established by the Marine Department to consider the period of seagoing service.

The explanation of relation and correlation of tasks in accordance with paragraph 2, shall be produced with format and detail as prescribed in the annex of this announcement.
