In order to welly facilitate the seafarers’ competency examination application for certificate of competency obtainment, certificate of competency renewal, certificate of endorsement issuance, certificate of proficiency issuance, including seagoing service, under Regulation of Marine Department on Examination for Seafarers B.E.2532 (1989) and amendments, Regulation of Marine Department on Training, Examination and Certification for Seafarers B.E.2541 (1998) as amended B.E.2542 (1999), and Regulation of Marine Department on Training, Examination and Certification for Seafarers B.E.2557 (2014), as well as to protect the innocent third party from the usage of forged certificate or document.

By virtue of Clause 5 of Regulation of Marine Department on Training, Examination and Certification for Seafarers B.E.2557 (2014) under Section 279 of the Navigation in Thai Waters Act B.E.2456 (1913), Director General of Marine Department repeals the Marine Department Announcement on Submitting Forged Documents, Using Forged Documents, or Informing False Statements to Official which was issued on 5th August 2015, and issues the Marine Department Announcement on Counterfeiting Forgery, Using Forged Documents or Informing False Statements to Official in order to set standard punishment for the forger, the forged document user or the false statement informer to the Marine Department official as follows.

Article 1 In this Announcement, “certificate” means certificate of competency, certificate of endorsement, or certificate of proficiency issued under Regulation of Marine Department on Examination for Seafarers B.E.2532 (1989) and amendments, Regulation of Marine Department on Training, Examination and Certification for Seafarers B.E.2541 (1998) as amended B.E.2542 (1999), or Regulation of Marine Department on Training, Examination and Certification for Seafarers B.E.2557 (2014), as the case may be.

Article 2 In case that Marine Department finds whoever counterfeits certificate or seafarer document issued by Marine Department, uses forged document, informs false statements to Seafarers Standard Division or Marine Department official, or takes any action which states false information of certificate or seafarer document issued by Marine Department, Seafarers Standard Division shall appoint a committee which comprises Director of Seafarers Standard Division as chairman, and no less than two Marine Department officials as committee members. The committee shall investigate whether or not there is counterfeiting certificate or seafarer document issued by Marine Department, using forged documents, informing false statements to Seafarers Standard Division or Marine Department official, or taking any action which states false information of certificate or seafarer document issued by Marine Department.

If the guilt is found, the committee shall report to Director General of Marine Department who shall sentence the offender as the person who has bad behaviour referring to Section 278 of the Navigation in Thai Waters Act B.E.2456 (1913), and not allow the offender to apply for certificate examination which is at higher level than the holder’s current certificate within no longer than ten years depending on Director General of Marine Department’s judgement according to the offending behaviour. Moreover, Director General of Marine Department shall order the division which is responsible for seafarer registration to record the offender’s behaviour as evidence and order the relevant division to prosecute all accomplices in the above offences.

Article 3 In case of requirement to appeal against the order according to Article 2, the person must lodge the appeal against Director General of Marine Department’s order within fifteen days since the order receiving date, otherwise the rights to appeal end.
